Privacy & Cookie Policy

This statement sets out the Nathan Timothy Foundation ‘The Songwriting Charity’ policy in relation to the holding and using of information, which we may obtain from you in the course of your visit and use of this site or other channels named further on in this policy.
 
Nathan Timothy Foundation 'The Songwriting Charity' (the “Charity”) is committed to protecting the privacy of its users. This Privacy Policy (“Privacy Policy”) is designed to help you understand what information we gather, how we use it, what we do to protect it, and to assist you in making informed decisions when using our Service.  Unless otherwise indicated below, this Privacy Policy applies to any website that references this Privacy Policy, any Company website, as well as any data the Company may collect across partnered and unaffiliated sites. 
 
For purposes of this Agreement, “Service” refers to the Charity’s service which can be accessed via our website at www.nathantimothyfoundation.org, www.songwritingcharity.org. The terms “we,” “us,” Charity," "Service," and “our” refer to the Charity. “You” refers to you, as a user of our Services, website and third party sites containing our work.
Visitors to our website
When someone visits www.nathantimothyfoundation.orgor www.songwritingcharity.org we use Google Analytics, to collect standard Internet log information and details of visitor behaviour patterns. We do this to find out things such as the number of visitors to the site, referral source (direct, email, organic search, paid search or social media) content consumed or shared and duration of visit.
Cookies
www.nathantimothyfoundation.org and www.songwritingcharity.org incorporate the use of Cookies. Cookies are small data text files that are sent from a server computer during a browsing session. Cookies are typically stored on your computer’s hard drive and are used by websites to simulate a continuous connection to that site. In order to make our site more responsive to your needs we use cookies to track and manage information relative to your specific interests. In this way we can tailor our site to your needs, deliver a better and more personalised service and track the pages on our site that you visit. 
 
The use of cookies automatically identifies your browser to our computers whenever you interact with our site. Your browser option allows you to disable cookies. You should note that if you do disable cookies, you may not be able to access all the services on this site.
 
Weebly has made available a default Cookie Notification for EU Visitors and provides visitors with options for more informed control of their browsing experience. This complies with online tracking consent application  and information requirements of the EU ePrivacy Directive 2009/136/EC and the General Data Protection Regulation (GDPR);

Website hosting
Our website is hosted by Weebly, Inc. (“Weebly”).  Weebly provides us with a comprehensive website builder and if required an online e-commerce platform.  When you complete a Workshop Enquiry or a Contact Form including your name, school name, contact email and telephone number, this information leaves the UK/EU zone and is stored in the US and stored on Weebly’s servers.  By using the contact and enquiry forms on our website, you consent to Weebly’s collection, disclosure, storage, and use of your Personal Information in accordance with Weebly’s Privacy Policy available at https://www.weebly.com/uk/privacy

Weebly also collects anonymous information about users' activity on the site, for example the number of users viewing pages on the site, to monitor and report on the effectiveness of the site and help us improve it. 
Your rights regarding the use of your personal information  
You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user via any email marketing platform, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail.   Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy or Cookie Policy or changes to our statutory status as a Registered Charity, or notices regarding forthcoming AGM/EGMs.
People who make donations to us
We have never, nor do we currently use a commercial fundraising agency to solicit funds from the public. We have always sought to utilise free online and offline tools and resources that exist to support charities fundraising activities. These are four ways in which members of the public can make a donation to the charity:
 
1. The charity uses aservice called MyDonate, a service run by British Telecom PLC and as part of the company’s Corporate Social Responsibility programme.  We do not and cannot accept or store credit card, debit cards, nor do we operate any electronic payment solution.
 
MyDonate  is a no fee, no commission, online fundraising service for UK based charities to raise money using BT’s own end to end, payment industry security compliant payment processing system, BT Safepay. The Service includes the operation of the MyDonate website, the collection of charity donations, management of the collection of Gift Aid from HMRC, and transfer of funds via BACS to your designated bank account.

2. We use a free SMS donation facility operated by Just Text Giving and Vodafone. We do not process donor information nor see any personal details. This service is free to charities and as such, reporting functions aren’t available to those who aren’t on a subscription plan with Just Giving. We have no database of SMS donors, nor have access to any information pertaining to donations made. We receive only remittance notices from the Just Giving Foundation once SMS donations (and any Gift Aid) have been received and processed. 3. We receive donations through https://www.giveasyoulive.comand https://www.thegivingmachine.co.uk
TheGivingMachine is a fundraising charity setup to help other charitable causes raise money online. By signing up and shopping online via TheGivingMachine members of the public will generate a free cash donation for us. Once registered, donors (referred to as Givers on The Giving Machine) receive information and offers directly from this organisation. Givers can opt-out of communications at any time.
 
Give as you Live is an online fundraising platform allowing users to shop at over 4,100 top stores and raise free funds for charity. The store pays Give as you Live a percentage of your total purchase price in commission and of this, 50% is passed on to charity.

Accounting
We use a pay-monthly online cloud-based accounting service called QuickBooks, operated by Intuit Inc. Quick Books is used to raise and send invoices, produce and provide management accounts for review by the charity’s Trustees, to monitor project and operating budgets and to provide the basis for the preparation of our annual accounts for filing with HMRC and the Charity Commission for England and Wales. Access to QuickBooks is limited to named members of the charity’s workforce and accountants only.

Charity banking
We conduct all of our charity banking through CAF bank Limited, a subsidiary of the Charities Aid Foundation (registered charity number 268369). If we are sent donations via cheque we deposit these donations over the counter at a branch of HSBC Bank. HSBC provide over-the-counter banking services for CAF Bank Limited in England. Donations made online to the charity can be done via BT MyDonate links on our website or through fundraisers using MyDonate to support us. MyDonate then instruct us via email of a BACS transfer date for donations  (and any Gift Aid collected) to be transferred to our bank account. 
Subscriber newsletters and marketing communications
We use a third party provider, Mailchimp, to email subscribers. When we send emails to subscribers, we will be able to see recipients’ behaviour such as who opened the emails and who clicked links contained in the email. This allows us to measure the performance of our email campaigns and to improve our features for specific subscriber groups. 
 
In general, members of the public who are interested in learning more about our work, teachers or schools keen on making workshop enquiries and individuals or companies expressing an interest in supporting our work can contact us in the following ways:

  1. By completing a Contact form on our Weebly website;
  2. Using an email address directing them to name (at) SongwritingCharity (dot) org to contact directly via the website;
  3. Via the charity’s social media channels (listed in ‘People who contact us via social media’);
  4. Via info@songwritingcharity.orgwhich is listed on our Charity Commission entry;
  5. When a donation is made via BT MyDonate, donors can indicate whether they are happy to be contacted directly by the charity. If such consent is given we add them to our Mailchimp Subscriber list.

People who contact us via social media
We do not use any social media CRM applications such as HubSpot or SocialPilot. Social media interactions are handled directly on all of our social media accounts; Facebook, Twitter, LinkedIN, Youtube, Google+ and Pinterest. Most interactions occur on Facebook, Twitter and YouTube, with Facebook providing the vast majority of and Twitter acting as the main social communications channel. 
If you send us a private or direct message via social media the message will be stored in the channel’s Direct Message area for three months. We will not share your messages or contact information with any other organisations. Please refer to individual channel’s own privacy notices for further information on how your data and communications are handled and managed:

People who email us
Email hosting for the Charity is provided by UK2.Net. All data is held in the location in which we signed up for the service which is the UK. As the Data Processor (our data which is on UK2.Net services) UK2.Net commit to:
 
  • Processing data solely for the purposes of providing our services: UK2 will never use this data for anything other than the essential operation of the service i.e. not for marketing or data mining.
  • Informing you (us) should we (UK2.Net) ever use a subcontractor to process your personal data.
  • Reporting any data breach to you (us) without undue delay (caused by our actions as a processor).
  • Helping you (us) to meet your regulatory obligations by providing reasonable documentation about our (UK2.Net) services.
  • Securely storing your (our) data and applying strict security standards and processes.

Links to other websites
At certain times it will be necessary or appropriate for us to provide links to other websites, for example, songs written during our workshops are uploaded to our music depository SoundCloud where songs can be streamed or downloaded for free, or to highlight an article on a news site or project partner’s website. We are not responsible for the privacy practices employed by those websites or the information or content they contain. 
 
This Privacy Policy applies solely to information collected by us through our website. Therefore, this Privacy Policy does not apply to your use of a third-party website accessed by selecting a link via our website. To the extent that you access information or creative work through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them.  
Right to Erasure (also known as Right to be Forgotten)  
What is the right to erasure? The Information Commissioners Office is clear that Under Article 17 of the General Data Protection Regulation individuals have the right to have personal data erased. This is also known as the ‘right to be forgotten’. The right is not absolute and only applies in certain circumstances.

​When does the right to erasure apply? Individuals have the right to have their personal data erased if:
  • Personal data is no longer necessary for the purpose which we originally collected or processed it for;
  • We are relying on consent as the lawful basis for holding the data, and the individual withdraws their consent;
  • We are relying on legitimate interests as the basis for processing, the individual objects to the processing of their data, and there is no overriding legitimate interest to continue this processing;
  • We are processing the personal data for direct marketing purposes and the individual objects to that processing;
  • We have processed the personal data unlawfully (ie in breach of the lawfulness requirement of the 1st principle);
  • We have to do it to comply with a legal obligation; or
We have processed the personal data to offer information society services to a child.
The Right to Rectification
Individuals have the right to have personal data rectified where it is inaccurate or incomplete on our website, for example if a school has been incorrectly attributed to a song or video.
Changes to our Privacy Policy
The Charity reserves the right to change this Privacy Policy and our Terms of Use at any time. If we decide to change this Privacy Policy, we will post these changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. Any such modifications become effective upon your continued access to and/or use of the Service five (5) days after we first post the changes on the website or otherwise provide you with notice of such modifications. It is your sole responsibility to check this website from time to time to view any such changes to the terms of this Privacy Policy. If you do not agree to any changes, if and when such changes may be made to this Privacy Policy, you must cease access to this website. If you have provided your email address to us, you give us permission to email you for the purpose of notification as described in this Privacy Policy.

This English-language Privacy Policy is the official statement of our online privacy practices. In case of any inconsistency between this English-language privacy policy and its translation into another language, please note that this English-language document prevails.
